I am planning to petition my partner who has still a valid marriage with her ex husband (from the philippines)
she has now filed a divorce in the US and we're planning to get married afterwards.
Do we have a complicated case? since she is still married in the philippines.
Do we still need an immigration lawyer for her application?

i would consult a lawyer in your case. You dont necessarily have to get one full time. It sounds like you might have to petition using common law as you can not get married until divorce is settled. CIC will let you file even if you are married if you can prove your separation, and on going divorce. You will also beed to have lived together for atleast 12 months and show proof of that too.
So yes i personally would advice you to consult a lawyer. Common law combined with divorce is not straight forward.

if its after the divorce, then i see no problem. It should be fairly straight forward, and no lawyer would be required though that decision is solely upto you. You can put the application together by yourself then just have a lawyer review it. That costs significantly lower. Otherwise just gather all your proofs of relationship, and required documents, and you should be alright. The forum has some threads on how to organize your application. That can an give you a guide. good luck
