I am living with my girlfriend in Canada for 2 years and we have decided to get married. We both have submitted our permanent residence application separately. But I have submitted my criminal rehab and trp application too as I have a 8 years old dui conviction on my record. That means I may be criminally inadmissible to Canada.
I need a little help with my question please
If I marry my girlfriend in Canada ,will that make her inadmissible too.? She is expecting her permanent residence in about 8 months. Her criminal record is clean and she submitted her own application for permanent residence..
Thank you
You said that you have been living together for 2 years, is that correct? If so, did she include you as her common-law partner? If not, then you have already lied on the application. As far as I know, if one spouse is inadmissible, so is the other. I will let others more versed in inadmissibility verify that though.
You need to get your applications straightened out ASAP. As it stands right now, BOTH of you are committing misrepresentation by not listing one another as common law spouses. Only one of you need file an application listing the other as a dependent, however, your DUI WILL complicate things. There are ways to 'fix' the issue, but you both had better start with your initial applications and withdrawing them before you get nailed for misrepresentation and deported/banned from Canada for a few years....
Once you have withdrawn your respective applications you can then look into what is needed to get your DUI straightened out and sorted.
