No ...He is single
He doesn't qualify for an open work permit in that case. You've misunderstood the rules.

People in Canada on a TRV do not qualify for an OWP simply because they are in Canada as visitors.

You have to be holding a TRP to qualify. TRVs and TRPs are not the same thing. TRPs are special permits that are granted to people who are otherwise inadmissible to Canada (usually due to a crime they committed outside of Canada).

If he wants to work, he needs a job offer and approved LMIA so that he can apply for a closed work permit.

Then he doesn't qualify for a open work permit. Open work permit are for applicants who have spouses in Canada that has a NOC O, A or B job or have applied for PR spousal application etc.
Thank you guys.... So an applicant who has spouse in Canada can get an OWP ? even if the person getting the permit is outside of canada ? or do they have to be IN canada to get that... ?

Depends on the spouse's status in Canada. For example, if they are a PR or citizen - no OWP. If they are here on a work permit - their job has to be a NOC A, B or 0 role.

No - they don't have to be in Canada to apply for the OWP. They can be outside of Canada.

My husband has a valid work permit and inside Canada. I am in Canada holding a visit visa. I want to apply for OWP and student permit for my 15y/old daughter who is in the Philippines. Is it possible to do our application together (owp inside canada, student permit outside canada)? Or shall I process my OWP first and submit her application for student permit later after i got approved?

You can apply at the same time but they are 2 separate applications. You spouse work in NOC 0, A or B to qualify. When does his WP expire?
