I am applying for FSW category 3 choosing Buffalo as processing office , i have completed 1 year here and i am sending applicaiton on July 2.
My NOC category is 2173 as for guys in canada for 1 year , 38 list of occupation doesnt apply.
My question is , if i leave Canada after applying to CIO , during second stage will it affect my application as Buffalo office asks for updated reference letters and that time i wont be able to produce a proof saying that i am in canada/working in canada.
Also both of my address will change in applicaiton to India Address - will this affect my application ?
Or will buffalo consider my case as i was in canada during the initial application i.e to CIO.
This is a hypothetical question as there are few chances of me leaving before CIO sends the approval.
Please share your views - has anyone facedthis , was it approved?
My view is that they say you must be working at the time you send in your application and have worked for the previous 12 months (or studied, that works too) but as far as I know, they don't say anywhere that you need to still be in Canada by the time your processing is completed. Rule of thumb, if it's not forbidden, then it's allowed so I don't think you'd have a problem. Not unless you fnd somewhere that they do say that you have to still be in Canada by the end of your processing. You can call CIC and ask but at least let them know if you move so they know where to contact you, that or have somebody really responsible sit at your Canadian address and get your mail for you.

"7) Does residing legally in Canada entail holding a study or work permit? Is a temporary resident status after the expiry of a work or study permit sufficient? What happens if an applicant leaves Canada after the work or study permit expires and then re-enters Canada (i.e. as a visitor)?
The Ministerial Instructions do not mention work or study permits at all (consult section 8.3 of the OP 6 manual). Generally, applicants must meet the requirements of the Instructions on the application received date. Once an application is placed into processing, the eligibility requirements of the Ministerial Instructions no longer apply, unless an error comes to light. Whether an applicant whose application is placed into processing, is still residing legally in Canada as a TFW or student, at any point after processing begins is immaterial. Processing is only subject to the IRPR and not the Ministerial Instructions. If an applicant met the requirements of the Instructions on the application received date, then left Canada and re-entered with the status of a temporary resident only (not a TFW or international student), the application is still eligible for placement into processing at the visa office. If the applicant only applied after re-entering Canada and remained in the country as a temporary resident, the application is not eligible for placement into processing."
