I am posting this here too, because it seems that on the tax section it's pretty quiet and maybe someone here can help.
So I have a problem, I'm not sure do I need to fill out my taxes as non-resident, deemed resident, deemed non-resident or just as resident? (factual resident doesn't apply because I still need to be considered a resident of Canada for income tax purposes. And I'm not anymore.. after my visa expired)
Here is my case: I worked in Canada until June 2012 (this was when my work permit expired), I returned to my home country for 2 months and flew back to Canada as a tourist and stayed there until December. My husband is Canadian.
I assumed I would fill out my taxes as deemed resident (stayed in Canada more than 183 days and my home country is not taxing me from Canadian income because I worked there already on 2011), but because I have ties to Canada (my hubby), I'm not quite sure anymore. I am currently in Canada again, as a tourist waiting for my PR.
I believe you would have to file as a deemed-resident despite the fact that you were here as a tourist. This is because you have spent more than 183 days in Canada. You also have ties to the country i.e. your sponsor. I am assuming you also have bank accounts and what not? Also, you will be taxed on your worldwide income (that is income made in Canada and outside Canada) as a deemed resident. Depending on your situation, you can also claim spousal credit (if you lived together with your spousal and you are supporting your spousal or vice versa). I dunno if this helps.

Thank you this helps a lot!! I was going for the deemed resident as well, but needed someone to confirm this to me. I do have bank account etc in Canada, so yes, I will file my taxes as deemed resident. Thanks again!!
