Hi All,

I am a PR in Canada. My girlfriend (fiance) had applied for TRV recently from India. But recently got rejected on the grounds of lack of family ties and travel history. Also, we did not show any connection between us. We showed hotel bookings where she would have lived and it would be a purely tourism trip for 3 weeks. I called for the GCMS notes and in one of the grounds it is mentioned that "I am not satisfied that you have truthfully answered all questions put to you"

I will be going to India in Jan to get married and after coming back will put in the spousal application. I am just worried will this cause any issue. I can always prove our relationship is genuine. We have pictures when we were dating and will do a proper Indian wedding of which we can submit pictures. Can they raise grounds of misinterpretation?

Please clarify.

What was she untruthful about? If there is nothing on the application that's false, it won't be an issue. They can certainly bring up misrepresentation if they find out she lied on the application. She doesn't have to mention you since you aren't married or common-law.
 
I'm sure on one of the forms for spousal sponsorship there is a question that asks have you ever been refused entry into Canada Yes/No and explain if yes.

Also something must of seemed untruthful or suspicious. A foreign citizen traveling Canada solo isn't a red flag but maybe some part of the itinerary was red flagged. Like missing dates or lack of evidence that the person will actually leave Canada on time.
 
Based on what I've read here I don't think her refused visa will cause a problem for spousal sponsorship. My husband had two student visas refused because of lack of ties to home country, financial, travel history and not believing he would leave when his visa expired. We talked with an immigration consultant about our whole spousal sponsorship application and she didn't seem concerned with the refused visas at all. As long as you haven't lied on the applications anywhere and there aren't and inconsistencies between them (because you can be sure they'll read the refused visa application) I think you have nothing to worry about!

No.. Nothing was untruthful on the application.

Thanks a lot.. There was no lie on the application. But we did not disclose our connection in the application.. And when we apply for sponsorship from our story it will be apparent that we knew each other at the time of TRV application. So I was worried if they say that u witheld info.. It seems from your answer that it won't have a problem. Can you please confirm my understanding?

If it was not required in the TRV application form to mention anything about her ongoing relationship with anyone, then it wouldn't be a problem. However, the question here is that why the visa officer was in doubt on a particular issue? It could simply mean that he or she thought the applicant wouldn't return on expiry of visa...If so there won't be any issue.

I think the issue was the OP clearly felt that if he mentioned the fiance, then they would reject the TRV. So he decided to pretend she was just a friend. But that backfired because the person reviewing her file could tell that he was inviting more than just a friend.

So now instead of getting a standard TRV refusal or even an approved TRV, his fiance now has a refusal AND a record of not truthfully answering the questions, so her chances of getting another TRV will be very slim.

My wife got her TRV, and she clearly mentioned she was visiting her husband, and has a PR application in progress.

Bottom line is you should always be honest from start to finish.
