can anyone has the same situation like me?
Stage 1- fam sponsorahip was refused
Stage 2- h&c grounds on process (forwarded to manila office)
What is our chace of getting approved?
We are family of 4 (my husband/me/4yrs old daugther and 5yrs old son).
Any feedback will help. Thanks
Depends why you were refused and what H&C grounds you have claimed.
Stage1 was refused due to my husband is over age and as per our lawyer refusal is expected. We claimed h&c because my mother in law need someone to be with her in canada dud to her health conditions.my husband is the only child and his father died in canada last year. So the lawyer adv to do h&c application.
So your mother in law was the sponsor - and she sponsored your husband with you and your children as dependents. I think the chances of the application being approved under H&C are very low in that case.
I would start looking into other ways your family can qualify to immigrate to Canada - specifically through an economic stream. Have you checked to see if you qualify to apply through Express Entry?
Yes its correct my mother in law is our sponsor. We didnt go thru express entry because the lawyer told us that the case is strong. We cant do anything right now because the final decision will be made here in manila office for further study. Have you encounter anything like this situations?
I personally haven't heard of any cases like yours being approved.
If you qualify for Express Entry - this would have been a far better choice.
Scylla thanks for the information. Will consider that option.. thanks again

Typically H&C cases are for the situation of the
applicants, NOT for situation of the sponsor. I would say the H&C case is very weak, and lawyer may have exaggerated your chance of success in order to get your business. I assume after all the lawyer is getting paid whether your case is ultimately successful or not.
Does your spouse's mom have any other family living inside Canada?
none she dont have any relatives living in canada
none she dont have any relatives living in canada
If she doesn't have any relatives in Canada, no parents living anywhere in the world, and no relatives who are already Canadians living anywhere in the world.... then she would be able to sponsor under the "other relative" category. Not sure if that was considered?
