Hello,

I am a Canadian citizen. I've sponsored my wife to get a PR card.
Our son is a Canadian citizen as well.
My wife asked to renew her card in 2011, but unfortunately we had to return to my wife's home country before the new card was ready.

Now 2018 we are ready to settle in Canada.
Her PR card has been expired since 2011.

I read in this thread that since I am a Citizen of Canada, my wife's time abroad with me will count against her Resident days.


My wife must come back with me and our son.

We are planning to cross the Canadian border at Peace Bridge in Fort Erie, Ontario. Can she hand her expired PR card in to the border officer?

How should we proceed at the border?
Please let me know.

Carry any documents you have that show you have been with her outside the country accompanying her. Be prepared to likely get sent to secondary and explain to them why your wife is not in breach of RO and what you have been doing away all this time. They will let her in. If she does not require her PR card for travel she can wait to apply for a renewal, however, if she does require it, then send in all the documentation you have to ensure it is approved.

Leases/mail/bills/pay stubs showing both of your names or anything else that proves you both resided together outside Canada is what she'll need to ensure they don't give her a hard time.

I have a marriage cerificate translated to english. That document is the same document I have provided Immigration Canada with when I first applied for my wife's PR card.
My Canadian passport And our son Canadian passpor.

Your marriage certificate is of no use in this situation. You need proofs that you and your wife were LIVING together in a foreign country. Things like bills, or a lease, doctors appointments, anything that has both of you listed at the same address at the same time. These are the things that will prove you were with her and that she meets the RO. You will want to ensure that you have a variety and the range extends the entire time you were both gone from Canada. Pay stubs are only a recommendation of something you might have that lists your home address. If your wife worked, if she has pay stubs that also list her home address, these are the kinds of things that prove she was accompanying her citizen spouse and is not in breach of her RO.

Your wife does NOT need a PRTD . A PRTD is only required to board a flight entering Canada.

CBSA will NOT apply to get your wife her new PR card. She will fill out a renewal application once you are both back inside Canada. She will need to include the same types of documents mentioned previously to ensure they understand she meets the RO and is qualified for renewal. When she fills out the renewal application she will mark that she has been outside of Canada accompanying a Canadian Citizen and include aforementioned documents.

Your son does not need to cross the border with you, however you mentioned that you would have his passport. You need to ensure his grandparents have his passport as well as a note from both you and his mother that it is ok for them to travel across an international border with him. Yes, they very well could encounter trouble without these items.

I understand that the CBSA at POE will send us to secondary inspection.
The secondary officer will ask questions and look into all the proof of addresses documentation.
After 2-3 hours the officer may or may not report her inadmissible under s.28

- in case the officer report her, he will ask my wife to sign a copy of the report and then will let her in because she has the right to appeal. After entering in Canada my wife must apply asap for PR card renewal and she must submit the proof of addresses documentation. She may receive a new PR card in the next 9 weeks or inadmissibility order. Next step would be an appeal.

- in case the officer does not report her and let her in, she does not need necessarily to apply for PR card renewal right away. She could keep her expired card for 730 days, and then apply for PR card renewal with no need of submitting those addresses documentation shown to the secondary inspection officer previously.

I really appreciate your advice.

If you have the cohabitation proofs, she won't be reported. If you don't have the proofs and she is reported, she needs to appeal and sort that out before applying for a new PR card.

No, she doesn't need to apply for a new PR card right away. However, if she has the documentation, it make no sense to wait.
