Hello everyone,
I am new to the forum and would like to seek some advice regarding my dependent child.
This week I just received my positive NOD and planning to apply for permanent residency
I have a child who was 21 years old on the date I submitted my refugee claim but now he just turned over 22 last month. Also he already started working before I made the claim.
I did some research that his age should be locked in on the day I submitted my claim? If so he only needs to maintain as single? Or he will be ineligible due to his work history as officer may seen him as financially independent? As based on my representative he won’t eligible due to his work history. But still I couldn’t find any requirements by IRCC for financial independent.
Thank you in advance.

As long as he is locked in at the time you submit your claim, work history doesnt really matter

Hi Simba,
sorry I just have one more concern. Does my dependent child have to be listed on NOD? As he was not a refugee claimant, but I did listed him on my BOC form.
Thanks again

As long as they were included as a dependent on your asylum claim they should be fine. How did they start working before you made a claim? Did they come to Canada on their own WP? I have limited information about your family’s immigration history. Would suggest getting a second opinion from a lawyer/consultant who has access to all your information or asking more questions to your consultant about why your child wouldn’t be part of your claim.

Hi,
Yes my child is on his own WP. I listed him as my son when filling the BOC form. Also I did some research as stated on IRCC website:
Eligibility of family members
Once it is determined that a protected person is eligible to apply for permanent residence, their spouse or partner and dependent children in Canada and/or abroad who are included in the application are also eligible, provided that they meet the definition of “family member” in
R1(3). For the most part, the IRB issues a notice of decision to all family members included in the family unit, should they have made a claim in Canada.
List all family members (including non-accompanying)
Protected persons, like all applicants for permanent residence, are required to list all family members, whether accompanying or not.
R176(1) permits the protected person to include any family member, whether the family member is in Canada or abroad. Only those family members who are included as accompanying in the application will be examined.
It does not specify if the dependent has to be protected person or not, as been listed on NOD would that make the person as protected person?
Thanks again for your response
