Dual intent LMIA - 1 year in business requirement question

Hi all,

My potential employer wants to pursue a dual intent LMIA for me, but he hasn't been in business for 1 year. We are relying on an experience lawyer for the process and he said that although there is a requirement for the business to be at least 1 year old, we can still pursue the LMIA, because there is hope.

Has anyone ever heard directly or indirectly of Service Canada waiving that requirement? I am just confused as to why an established lawyer would proceed with something that on paper is impossible.

Maybe because the lawyer is simply looking at their fee and having advised you of the guidelines it is still a win for them whether application succeeds or not they as have given you the advice leaving the choice on you should application fail.
