We (myself , wife and Kid) came to Toronto Last May 2008 on Work permit. My contractor is from India who has a Subsidary office in Canada(Missisauga), So i got a appointment letter from Canada office Stating that " Please accept our Heartiest congratulations on having been selected by XYZ india for an assignment with XYZ Canada Inc. XYX canada is obtaining your service on a temporary basis for the duration of assignment from XYZ India(refered as Parent company). The Expected duration of your assignment is for a max period of 24 months or till your work visa Expires, which ever is earlier"
My work visa expires my May 2010 and its possible to get extended also
We are planning to apply for Permanent Residence as Federal Skilled worker since we have completed one year on Work permit, My confusion and doubt is Can i apply in Category 2 (For persons who have arranged employment offer with a Canadian employer). Does this offer letter from XYZ canada fits this category. please help me in regards.
Hi -see this thread also -

Can you get a letter from your employer stating that, if you are approved for permanent residency, that your temporary employment will become permanent? In other words, have they / will they offer permanent employment contingent on your application for PR being approved?
The difficulty is in fields (like mine) where fixed term contracts are the norm, not "permanent" employment...
Thanks for the reply,
I dont think its NOT possible for me to get such letter from my contractor. so i think i better opt for Cat-3 for which i already qualify.
Suppose if i apply in Cat-2, how long will it take to get a reply from CIC whether i am qualified in that category. please let me know. so that i can take a chance
Sorry spelling mistake,
I meant to say, "its not possbile to get such a letter from my contractor"
The application goes first to CIO, for me it took about 2 months to get approval - seems to be getting a little longer lately.
They will evaluate your documents and assign you as Cat 3.
Thanks Jes_ON
As you have mentioned i got reply from CIO and have asked me to forward my application to Buffalo office within 120 days. I have been assigned a reference number also for the same. I hope now it may take more than a year to get all the process completed.
Meanwhile i have a query, My contract with my Canadian company is getting expired by Dec 2009, and i may need to return back to India after that. Now my big doubt is whether my Application will be transfered to NewDelhi (india) ? or will it be processed in Buffalo, Please reply me
So you are Cat 3, right?
Theoretically, your application COULD be transferred to New Delhi (or you could keep it at Buffalo, but I know New Delhi is faster these days).
Here's the thing - for Cat 3, you're supposed to be IN CANADA. And you were, when you applied (date application received at CIO counts). However, the instructions are silent on what happens if your work permit expires and you leave (for Cat 2, it is not silent - you loose your eligibility). We had this discussion in another thread - figured that as long as the instructions don't say it, you SHOULD be OK.
But, honestly, if I were you, I'd do my best to find a way to stay while the application is in process. I know you may not have a choice.
I haven't had any luck getting CIC to answer my questions, but you might try contacting them to ask...
Thanks for the reply Jes_ON,
Actually My work permit is valid till May 2010, unfortunately the contract expires by Dec 2009 with my employer and this time he is not ready for a extension due to recession he says but my contractors are trying for it. Lets hope the best.
I was reading some topics in this forum regarding time line for processing of the PR - "Applications filed through NS --> Buffalo (Filed from USA)"
but my case is "Applications filed through NS --> Buffalo (Filed from Canada)" . How long will this take , is this same as the filed from USA case. I read that if you are filing for CAT-3 from Canada to Buffalo office, it will be processed sooner than others. Is this true , someone please comments on this.
