Hello everyone,


My husband got the permanent visa, i still live in another country with my child (from another relationship. He ll be our sponsor. I have doubts about the required documents.


Me and the father of my child have joint custody, but the residence is fixed with me. Do you know if it ll be necessary to present the custody agreement ? Or authorization is enough?

If the custody agreement is necessary, can it be joint custody? Or it have to be the full legal custody? It can be translated or is necessary to homologate in CAnada?

You will need permission from the father or you will need to go to court to get full legal custody.
 
I think in your case you need both the 5604 form your custody paperwork and maybe an updated agreement. The best advise I can give is talk to a family lawyer and find out your country requirements. Then write a cover letter to cic to explain the whole thing . I too am moving with kids from prior. I have no papers at all as here a verbal agreement is enough if parents agree. My lawyer told me to write a letter to explain to send with 5604

A lawyer would only be needed if the other parent refuses to give permission and OP has to go to court for full legal custody.
 
Yes I'm aware they dont need one but ringing for free advise is a godsend that's what did ..
