Criminal Charge for sponsor

I am in trouble at this time. My husband who is my sponsor is facing criminal charge (since December, 2020) and he is fighting against it in court. My husband is in Canada and I am outland applicants. We submitted our application last year in February. 2 weeks ago I got pre arrival and last week I got additional document request for my husband (RCMP criminal record check). They have given us 2 months to submit Criminal Record Check. I don't know what to do with this outstanding criminal charges. Could you please provide me some suggestions. I am mentally exhausted at this time.

Someone misused his cellphone. He was charged with possession of pornography related to child.

That is definately something that could cause inadmissability imo.

Hire an immigration lawyer.

IRCC will most likely hold the processing of your application until your husband's charges are dealt with. I expect you're already working with an excellent criminal lawyer.

Should I write letter to IRCC explaining all circumstances and request them to hold processing until final result comes out from judicial process ?

I would recommend you get a consult with an immigration lawyer on your next steps.

Would also suggest you do some soul searching about your marriage. Someone misusing your husband's cellphone to download child porn would be a huge coincidence. Unfortunately many come up with excuses when caught with illegal material.
