Being married but not divorced could that be a red flag? My marriage was never registered in the UK. I was married 7 years ago. I have no idea where he is, we have not spoken to each other for 6 years. The marriage was in Brazil, please ask any questions
Depends upon the rules and law of your country that if you guys are not in touch and even do not know anything about each other and are not met since 6 years whether the marriage is effective till now or not... Can you apply for Divorce?

It is not a red flag. At the moment your only option is to file as common law. You can be common law while married to another. However having missing details like no address with your spouse may cause delays. You must have letter detailing your last known address of your spouse, including details of no contact with him. If you haven't done already. You can file for divorce if you can. If you can't, you can get a divorce in Canada after spending 1 year in Canada. Hope this helps.
I am filing common law I have his name and date of birth but that's it. I have no idea where he is. After getting pr I will try and get a divorce somehow. So letter explaining everything should be ok. I hope. Thanks screech339. I am from the UK handsup he is Brazilian I did registered the marriage in the UK so not so if it's even valid.

If you registered the marriage in UK, your marriage is considered to be legal and valid. Don't know the divorce rules/laws are for UK. All I know is you must be legally separated for 1 year before being allowed to start divorce proceedings. Thus why I said, you need to reside in Canada at least 1 year before being allowed to start.
As for the letter on the whereabouts of your spouse, I am only basing this on people in same situation as you and was able to explain in letter the problem. You may want to have the letter officially notarized as it need to be an official statement.
Ok so I will write a letter explaining the situation, then I take it down to a notary to be stamped is that correct? Sorry I did not register in the marriage in the UK
