I think it makes sense that if you send your application before express entry is announced, you will probably be processed under the old rules. It doesn't make sense to send the application under CED, they receive it after they announce express entry and then they process you under those new rules. Before they start with that, they will probably finish with all the applications that are sent before the express entry date. So if you have sent your application on Jan 1st and they open express entry on January 20th, you application will get AOR probably in 45 days but you will still be processed under the old roles.
It doesn't have an effect on the NOC, it has an effect on whether you meet the requirement of 1 year of employment. If I were the VO, I would question whether you actually started working on January 1, and if you did not, your application could be refused for not meeting the 1 year requirement.
