Im from the U.S. and have been in canada for the past 4 years going to University. me and my gf have been together for 5 years, she is a canadian citizen. couple of questions about getting PR.

1) do we need to fill out forms to be considered common law?
2) if she is going to sponsor me do we need to fill out forms for her to sponsor me as a common law partner? ( as in can we just say we are common law with out any forms filled)

Have you actually lived together for 12 continuous months? If so, then she can sponsor you as a common-law partner. You will need to show lots of evidence that you have actually lived together (so shared lease/rental agreement, joint financial accounts, mail delivered to same address, each other listed as beneficiaries on insurance, testimonials from friends/family, etc etc).

If you have lived together for 12 months, then hopefully starting in the year you reached 12 months cohabitation you each filed taxes with the CRA as common-law, and not single. To file taxes as single when you are in fact common-law, is tax fraud.

If you are considering common-law sponsorship this is a family class application, so you should post your questions to the "Family Class Sponsorship" part of this forum.
US citizens are usually recommended to apply for PR through family class using OUTLAND method, which means your app is processed in CPC-Ottawa and typically takes less than 1 year to process. The application package to review is here, you can start by reading the instruction guides: http://www.cic.gc.ca/english/information/applications/fc.asp
