You have to be LIVING together for 12 months. Not just together. Doesn't sound like you are living with each other, as you said he came in February and December.

If you and your husband are separated, I believe he can. If there are any children involved that complicates matters. I assume your BF knows that he will be financially responsible for you for at least 3 years?

But remember you have to live together for 12 months. Not sure how you are going to do that. Him come to philippines or you try to get a TRV for Canada. Probably easier him going there.

I've seen cases where people are still officially married but separated a long time ago from their husband/wife and apply under common law after living with their new partner for 12 months
Yes he can sponsor you. I’m married in the Philippines. And i just did my application by myself sometime some attorney doesn’t know about especially if that is not their field of work. Before i submitted my application i when for consultation about my situation in lawyer consultant but they refused to handle my case. I almost lost my hope because no one wants to help me and i said to myself i will try to apply by myself and i did it just follow and read carefully the sponsorship in the CIC website you can do it. Study and search everything you need to know to thats what i did. Even though your married CIC understand situation like that because Philippines doesnt have divorce they know it.you. Have to submit a explanation letter with your application.
