I became a PR in 2016. My partner and I have been living together since early 2016 and by definition became common law early 2017. We have not declared this.
We have not submitted our sponsorship application yet.
Several people have mentioned that our application will be refused as I have failed to officially declare that we became common law in 2017. What can I do? Should we submit IMM 5409 and wait until it’s approved before submitting our sponsorship application?
Just want to make sure we’re doing it the right way so that it doesn’t end up getting refused.

When the time comes, we’ll submit a complete application. My concern is about not having declared that we’ve been common law since 2017.
I don’t even know if I can retroactively apply for IMM 5406, wait for it to be approved then retroactively file my taxes and so on and then submit a complete common law sponsorship application?

Declare to whom? If you mean IRCC, they don't care that your relationship changed after you became a PR. There is no "IMM5406 approval", not sure what you mean by that.
You need to sort out your tax situation with CRA but you can apply for sponsorship now.
