i hope someone can reassure me that what we are planning to do will (most likely) work.
I am a german citizen, in love with a canadian woman.
We have been living together in the United States for almost a year, but it was only a few months at a time, so we will need to spend a year together in Canada before applying for permanent residency under common law rules.
The plan is as follows:
I will fly to canada as a tourist, and get a 3 months visitors visa (stamped in the passport).
2 months in, i will apply for an extension of that visa by 12 months, putting as reason "to achieve common law".
After 12 months there, i will apply for permanent residency, going the "extern" route. (Through Berlin, or is it Vienna now?)
Should that work?
We will book a return-flight to avoid problems at the airport with immigration, which i will not use of course.
The reason im planning to get a return-flight after 3 -and not 6- months is: I would like to avoid having to answer questions at the airport about my ties to germany. I already cancelled my job, so im a little scared that they might deny me entry if i answer "Do you have a job in germany?" truthfully.
My girlfriend in canada is employed of course and will provide for both of us.
