Hello guys,


i hope someone can reassure me that what we are planning to do will (most likely) work.

I am a german citizen, in love with a canadian woman.
We have been living together in the United States for almost a year, but it was only a few months at a time, so we will need to spend a year together in Canada before applying for permanent residency under common law rules.


The plan is as follows:

I will fly to canada as a tourist, and get a 3 months visitors visa (stamped in the passport).
2 months in, i will apply for an extension of that visa by 12 months, putting as reason "to achieve common law".
After 12 months there, i will apply for permanent residency, going the "extern" route. (Through Berlin, or is it Vienna now?)

Should that work?


We will book a return-flight to avoid problems at the airport with immigration, which i will not use of course.
The reason im planning to get a return-flight after 3 -and not 6- months is: I would like to avoid having to answer questions at the airport about my ties to germany. I already cancelled my job, so im a little scared that they might deny me entry if i answer "Do you have a job in germany?" truthfully.
My girlfriend in canada is employed of course and will provide for both of us.

That plan would work but why would you think you would get a 3 month stay limit. You could still get a 6 months max stay limit. My sister in law came to visit us (non-visa exempt) and told border agent that she was staying 2 months. She end up getting 6 month stay (has no return date stamp in passport). No date stamp, means 6 months max stay.
 
Any chance you could get a working holiday visa for that year? That avoids border issues and you can work.
