Common Law Question PLEASE HELP

I have been living with my boyfriend since Jan 2017, he had to go to a different city to do his coop every other 4 months(very regularly) in the last 2 years ... never changed his address on driver license or insurance.. I declared him as my common-law spouse NON-ACCOMPANY(not enough points) in my EE app. I just found out that for common-law relationship you actually have to live 12 months without gap? Will this affect my application? Please help!!!
