Me and my gf are living together from Nov 2021 and have lease from Feb 2022 to Feb 2023 then she went to a different city for work from May 2023 to Sept 2023and then we again stayed together from oct 2023 under a lease taken together. we have never mention as common-law in any IRCC application like PGWP application or in CRA. But we have each others name in work insurance beneficiary, work permit issued in same address, affidavit and bank statement proving financial aids.
she got ITA last week and we want to apply together as common law partners, but she applied as single.
can we apply together as common law partners now with the above proofs
I see that you keep all the dates in your new post.
So if you move in Nov 2021 and only lived together till Feb 2022, you did not live 12 months continously with your partner.
You then moved back together in Oct 2023 which is only 1 month.
As suggested in another post, you can consider getting married and then add to the current PR application.
Or she can applied as single and if the application is still not completed by Oct 2024, then update and add you as the common law partner by then. (it's 12 months living as common law by Oct 2024)
Or apply to sponsor you as common law partner after she becomes PR by Oct/Nov 2024.
