Hi Everyone , I am currently holding a youth mobility scheme visa to work in the UK for two years the visa ends in July of next year but I am wanting to sponosor my common law partner when it is finished who is currently in the UK into canada. We have been in a relationship for 4 years, and have lived together for 3 years in total. I am confused about the financial backing I need it says I need to prove that I can support my partner for 3 years? Does that mean I need a lot of savings money and how much>? I am also wondering if I sponsor him into canada and it gets approved can he work right away? or does he have to be enemployed for those 3 years, because that doesnt make much sense... he is very capable of getting a job here as he lived and worked here for a year before also he has a degree and great work experience , i thought as soon as the sponosorship was approved and he got his permanent residency that allowed him entry into canada to work or study , work in his case. If anyone could help me this is would be greatly appreciated , the site is straightforward but I still am confused about these two things . Thanks !

On the second point, your partner would be able to legally work as soon as he receives his successful PR notice. The 3 years is specified in-case he is unable to find work or if he is but later loses his job. In sponsoring him you are accepting that you are financially liable for him during his first 3 years in Canada. I believe that means he wouldn't be eligible for state benefits during this time but that may be incorrect.

Other people would be more helpful about the financial backing issue- I believe it does not apply in spousal class but again am not 100% if that is also correct for common law.
 
There is no delay for him after he gets his PR, he can find a job as soon as he lands to Canada.

You don't need any financial backing for common-law sponsorship, but since you are living outside Canada you will have to prove your intention to come back to Canada.
 
TO clarify - there is no minimum income, but you need to convince the government that you and your partner will not go on welfare when you get to Canada, so you have "a plan" - include all information you have. Previous assets, where you will live when you get to Canada, if your parents/friends are offering to host you until you get your own place, ask them to write a letter stating their intentions, you can also include the information about your partner, his previous work experience in Canada etc. CIC wants to see that you have a plan on how to support yourself and your family (partner in your case) to approve you as a sponsor. The focus will be on you, but you can also include information about your partner to show that you have thought about it.

My partner got approved and he has been a full time student for the last 3 years, only working 5 months during summer time.

You are signing the sponsorship agreement that you agree to be financially responsible for him for 3 years when coming to Canada, but of course - he can look for work as well! as soon as he gets his PR status and "lands" in Canada, he can legally work in Canada.

Thank you everyone for your help!! I was wondering also this outbound inbound type of application, if I am moving back to canada july of next year when my work visa is up in the uk and my boyfriend/ common law is still residing in the uk , should I be applying for the outbound application while I am in Canada?? I am assuming that would be the way to do it as he has a great job over there and wanted to save as much as he could before moving to canada if the sponsorship is approved. We have a lot of information gathered as well for our application , tons of proof ! Its like a big project lol

Hey Kims,

you can choose what suits you best and apply outland even if IN Canada... what determines outland or inland if which office you send your application to, and which forms you use. For your case, being from a visa exempt (UK) and a "fast" VO (london) there is no reason to do inland. If you want to understand more about inland/outland, go at the top of this page and read the first post by Leon about the pros and cons of both processes.

it can take up to a year to have the PR approved.

If you and your boyfriend have been living together for more than a year, then you can apply now (once application is ready) and keep on being together in the UK, while you wait for the PR to arrive. or you can choose and wait until you are back in Canada, and submit then, but it means that either you will be separated from each other, or your partner comes with you to Canada on a tourist visa, and is not allowed to work, go to school, access to healthcare etc ( healthcare is a tricky one as it depends on the provinces).

If you apply now, you will have to "prove" that you are serious about returning to the Canada. In that case, build your story - where you will stay in Canada, if you have assets there, the fact that your visa is expiring, what you will do for a living etc. CIC needs to be convinced that once the PR is granted, you will move to Canada. it's a little more work than applying once you are back in Canada, but it will also allow you not to be separated, and also - the fact that your partner can not work on a tourist visa can be quite stressful ( that's my case, believe me on that!), so if you have the possibility to start the process now, and get most of it done before moving to Canada, then it's probably the best.

As a canadian citizen, you can sponsor your partner either once back in Canada, or still outside of Canada.
