Claiming EI & PR

If a PR application is in process and based on a permanent job offer, can you claim EI if layed off.? Can EI be claimed whilst looking for another employer to take over a closed WP? What are the consequences of being on EI for PR application - Are CIC notified? Might it be best not to claim EI in this instance? Help please.

It dosent look good on your PR application. Its like going to a job interview and asking the hiring manager can I take 2 hour lunch breaks or can I watch movies in the office if there is no work to do

A PR application is not a job interview. Either you qualify or you don't. If you had qualified under CEC for example, it doesn't matter if you lose your job, quit even go back home, your PR still gets processed.

However, if you applied with a full time permanent job offer and the employer who gave you your job offer then lays you off permanently, you no longer have a job offer and this could jeopardize your PR application if immigration finds out.

There is no such thing as "taking over" a closed WP. You would need a new LMO and a new WP.

I doubt you will get EI either with a closed WP. You can try it but they will most likely tell you that it's not fair against Canadian applicants that they have to take any job that comes along while you collect benefits because the employers looking for people are not willing or able to get a new LMO for you.

It's temp lay off right now. Any ideas on how to get an open WP if your current WP is closed? Is that a difficult process? Any info on how to go about it would be great.

If it's a temp layoff, there is a chance that you will be approved for EI, you can try it.

You can read about bridging work permits here: http://www.cic.gc.ca/english/department/media/notices/2012-12-17.asp Your work permit must be expiring in 4 months or less though in order to get this. Another option. If you have a spouse who is on an open permit based on your permit and their job is skilled, your spouse could talk to their employer about applying for an LMO for them so they can get a closed work permit. You could then get an open work permit as a spouse.
