Hi Seniors
Please advice on if I should apply under FSW or CEC.
I work for a Top Tier IT company in Canada under ICT . I am eligible under CEC but have several issues with my application.
They are :
1) Employer has declared way less income on T4 than on employment contract. I get remaining income in home country and non taxable allowances in Canada.
Very tough to justify the difference.
2) Employer not willing to provide Job responsibilities in employment reference letter.
I will be in the top bracket with respect to points in FSW & CEC and hope to get ITA soon. Please advice if applied under FSW can I get around the above issues.
For Eg: Under FSW if I do not show my Canadian experience can I solve the problem.

ans: you can mention this in the covering letter and explain your job responsibilities. apart from that you can ask your manager through mail about your job responsibilities and he should respond to that he agrees to it. another option check your work permit petition file which your company might have filed initially to apply for your ICT work permit. there I am pretty sure its should have been mentioned.

The company only shared select documents with respect to ICT file. Remaining documents were directly submitted to consulate by attorney on behalf of me. I have a draft document on job responsibilities which I created and gave them, but the final document was not shared.
Is there a way the officer can refer my WP application and get the information from there.
Also , I will need some expertise to help me with issue of T4 and salary disparity. Do you suggest I should approach an immigration attorney.
I am able to get a reference letter from my client which is a top company in Canada. Do you think I should go for it or will it confuse the VO.

Why is it tough? Certainly that info is in a contract, and/or you will be able to somehow prove the amounts you receive in your home country. Write a letter of explanation and provide documentary evidence.
2) Employer not willing to provide Job responsibilities in employment reference letter.
This is more difficult, as it is the key piece of evidence. If you can provide proof that the employer will not give you a letter of employment (e.g. copy of email where they refuse to give it), then CIC may accept alternative proof of job duties, like those suggested by saja_roy.

Not really, you still need to provide the same documents for FSW, and more (you'll need to go back 10 years in FSW).
