I have a kind of complex situation. First I lived in Canada as a Permanent resident for almost 40 yrs. My step father sponsored me ( & siblings) as a child. At age 40, after my divorce, I moved to United States to work. I spoke with both, US & Canadian Borders to make sure it was ok. BOTH told me at the time if I did not like it there I could just return. They DID NOT tell me there was a limit on time. That was in 1999. In 2010 I entered Canada & was accused of trying to enter as a permanent resident. I gave my US Dr. License & US Passport & stated where I was currently living. . I did not try to enter as a PR. As a result, I was "ordered" to sign a "Voluntary" Relinquishment of my Permanent Residency form. I refused b/c it stated "Voluntary" & I did not know what this would me for my retirement nor my family. I still had a minor son living in Canada whom I retained sole custody of. I "allowed" him to live with his Dad but still retained sole custodial custody. I refused to sign & they held me until I would sign the form. When I did, I wrote beside my signiture, "Officer instructed me to sign or be written up" . The officer became extremely upset with me & tore up the form . I was given a "Departation" order. I appealled it & my appeal was denied. No surprise. The judge stated I had no ties to Canada????? He would not allow my 9 documented family members to speak because he said, quote," We will be here all day". He allowed the Borders statement which was sent in on FEB 11 and my meeting was on FEB 13th. He stated my son was born in 96 he was born in 94, he stated he felt I was "SOMEWHAT" truthful in my statements.... He stated my exhusband raised my kids & I had documented school records to prove they lived with me in the USA. He twisted everything throughout that hearing in his statement I received a month later denying me ever to come home. I had no lawyer because I have no fulltime employment. I am an instructor. I teach Motorcycle safety. He stated my motorcycle meant more to me then my children. My entire family lives in Canada. I am 53 now and had moved to Canada at age one. My entire retirement is in Canada, my children. etc. I have no family in the USA nor relatives at all. I am alone here. No job, No home, No family Nothing. Also I received a call from the CBS about a month after my Appeal hearing stating there was no record of me following the departation order so now it had turned into a a "Deportation" order. I explained I went into the Border office and documented me returning to the USA. I had proof of a hard copy they gave me. It didn't matter. I was still told I could not even enter Canada. Ive never been arrested in my life. Just a mom. I tried anyways and found out that someone went into my file & deleted my documented proof that I followed the departation order. The only thing that saved me was my hard copy they gave me. This issue has since been fixed now so at the very least now I can visit my children & family. The deportation order was deleted or removed. Thanks to FIVE wonderful men at the Border who knew something was not right. The supervisor there even said someone has gone into the system & deleted the document we issued to you in 2010. I knew then something / or someone is messing in my life. I cannot get anyone to help me prove this injustice.
My problem is I have a disabled sister who lives in Ontario and is getting worse. She has nobody to take care of her. She can barely walk & is loosing use of her hands. My younger brother also has some issues going on in his life. He is a long haul trucker & his common law wife has recently lost the right to be alone with their toddler son b/c of alcholism. She is not allowed to be alone with him 24-7. My sister wants us to rent a house and me take care of his son while he is gone during the week & be there to help her. My brother is born Canadian. My sister is a Permanent Resident of 50+ years & is on long term disability from her employer. She will never recover. She is a dyalisis patient that is gaining calcium deposits all throughout her body. She is turning into stone otherwise. Her arteries, joints veins, organs etc. There is no cure for this. Is there any way to gain sponsorship through either of them quickly? I can work & help them both. I do not need nor want social assistance. I recieved it one time when I lived there and paid it right back. I received 2 checks & paid them both back. I have always worked. I have a social insurance number and have had it since age 14. Is there any program that will help us?
