I have a kind of complex situation. First I lived in Canada as a Permanent resident for almost 40 yrs. My step father sponsored me ( & siblings) as a child. At age 40, after my divorce, I moved to United States to work. I spoke with both, US & Canadian Borders to make sure it was ok. BOTH told me at the time if I did not like it there I could just return. They DID NOT tell me there was a limit on time. That was in 1999. In 2010 I entered Canada & was accused of trying to enter as a permanent resident. I gave my US Dr. License & US Passport & stated where I was currently living. . I did not try to enter as a PR. As a result, I was "ordered" to sign a "Voluntary" Relinquishment of my Permanent Residency form. I refused b/c it stated "Voluntary" & I did not know what this would me for my retirement nor my family. I still had a minor son living in Canada whom I retained sole custody of. I "allowed" him to live with his Dad but still retained sole custodial custody. I refused to sign & they held me until I would sign the form. When I did, I wrote beside my signiture, "Officer instructed me to sign or be written up" . The officer became extremely upset with me & tore up the form . I was given a "Departation" order. I appealled it & my appeal was denied. No surprise. The judge stated I had no ties to Canada????? He would not allow my 9 documented family members to speak because he said, quote," We will be here all day". He allowed the Borders statement which was sent in on FEB 11 and my meeting was on FEB 13th. He stated my son was born in 96 he was born in 94, he stated he felt I was "SOMEWHAT" truthful in my statements.... He stated my exhusband raised my kids & I had documented school records to prove they lived with me in the USA. He twisted everything throughout that hearing in his statement I received a month later denying me ever to come home. I had no lawyer because I have no fulltime employment. I am an instructor. I teach Motorcycle safety. He stated my motorcycle meant more to me then my children. My entire family lives in Canada. I am 53 now and had moved to Canada at age one. My entire retirement is in Canada, my children. etc. I have no family in the USA nor relatives at all. I am alone here. No job, No home, No family Nothing. Also I received a call from the CBS about a month after my Appeal hearing stating there was no record of me following the departation order so now it had turned into a a "Deportation" order. I explained I went into the Border office and documented me returning to the USA. I had proof of a hard copy they gave me. It didn't matter. I was still told I could not even enter Canada. Ive never been arrested in my life. Just a mom. I tried anyways and found out that someone went into my file & deleted my documented proof that I followed the departation order. The only thing that saved me was my hard copy they gave me. This issue has since been fixed now so at the very least now I can visit my children & family. The deportation order was deleted or removed. Thanks to FIVE wonderful men at the Border who knew something was not right. The supervisor there even said someone has gone into the system & deleted the document we issued to you in 2010. I knew then something / or someone is messing in my life. I cannot get anyone to help me prove this injustice.
My problem is I have a disabled sister who lives in Ontario and is getting worse. She has nobody to take care of her. She can barely walk & is loosing use of her hands. My younger brother also has some issues going on in his life. He is a long haul trucker & his common law wife has recently lost the right to be alone with their toddler son b/c of alcholism. She is not allowed to be alone with him 24-7. My sister wants us to rent a house and me take care of his son while he is gone during the week & be there to help her. My brother is born Canadian. My sister is a Permanent Resident of 50+ years & is on long term disability from her employer. She will never recover. She is a dyalisis patient that is gaining calcium deposits all throughout her body. She is turning into stone otherwise. Her arteries, joints veins, organs etc. There is no cure for this. Is there any way to gain sponsorship through either of them quickly? I can work & help them both. I do not need nor want social assistance. I recieved it one time when I lived there and paid it right back. I received 2 checks & paid them both back. I have always worked. I have a social insurance number and have had it since age 14. Is there any program that will help us?
 
Unfortunately your sister can brother cannot sponsor you. They don't qualify.

Have you checked to see if you qualify to immigrate independently through one of the skilled worker programs?
 
I know my kids can sponsor me, but there is a freeze on applications. I do not qualify under skilled workers.

If your child is still a minor, then he doesn't qualify to sponsor you. You'll have to wait until he's older. In order to sponsor you, he will also have to be working and be able to demonstrate that he makes sufficient income to support both you and himself.

And yes - parent sponsorships are currently on hold and CIC isn't accepting new applications at this time.
 
My children are aged 27, 25 & 18. The 2 older ones are both employed and on their own. I have searched and searched all the different programs & rules. I was just hoping to be able to find out if there are programs for extenuating circumstances. This is so extremely unfair and wrong. Even the border officers told me not to worry, that 40 yrs in Canada would prove loyalty to Canada. Its the only home I have ever known. Had I been given the correct information back then I would had never left. My kids were very young then. All born in Canada. Ive lived from a baby until 40 yrs old in Canada and to be removed for breaking a condition I was never informed of was so unjust. The officers stated they just don't understand that judge. Criminals cross every day & are allowed to live there. There should be some way of overturning that judge's decision. He was more worried about getting out of the court room & denied me my rights then twisted the documented facts to justify his decision. I was married twice in my life, once to my children's father in Canada for 23 yrs & once here for 3-1/2 yrs. He made me out to be a motorcycle man chasing women in that decision. My daughter & my son both testified at the hearing. My daughter BEGGED him to let me come home. That she didn't even want to have a child until I lived close to her. My son told him I want mom here. I want to live with HER. He was still in high school then. The judge mis-stated the facts all through out his statement letter. There should be someway of fighting that.
 
Ignorance of the law won't be accepted as an excuse. It's up to each individual to learn and understand what is required to maintain PR status. (I'm not being unkind - I'm just telling you honestly and up front what the answer will be if you try to argue that it's not your fault. CIC does not react well to the "it's not my fault" argument. Saying this usually works against you.) Your case is pretty straight forward. You didn't meet residency requirements and this is why you lost your PR status. I don't understand why you didn't become a Canadian citizen during those 40 years. Then you could have left Canada and returned without any restrictions. But it's too late for that.

Anyway, it's too late to appeal. If you want to become a PR again, then you will have to apply again from scratch. Since you don't qualify as a skilled worker, I would recommend that you wait until November. This is when we expect CIC will start accepting applications for parent sponsorship applications again. Note that the current processing times for parent sponsorship applications is years. So it won't be a fast process.

For now you can certainly continue to come to Canada as a visitor (but can't work or live here).

Another option would be to find a job in Canada and apply for a work permit. This would allow you to live in Canada as a temporary worker. First you'll have to find an employer who is willing to offer you a job. That employer will then have to obtain an approved LMO (approval to hire you) and as part of this process, prove they couldn't find a Canadian to hire for the role. Once you have both of these, you can then apply for a work permit.

I want to apply for a travel document and i have a similar situation. I landed in Canada back in 2000 and came back to Somalia 2004 with my aunty. My aunty told me we were going for a two week holiday trip to see family members, I was lied to and those two weeks became 9 years. I was a minor (13yrs) when I left Canada and ever since I have been kept from going back, by my aunty. I am now 22 and want to return. So here are my questions:

1- I know that based on humanitarian and compassionate grounds I might be issued the travel document, however, I have an inactive habitats b. Will they issue me a travel document or refuse me based on medical grounds?

2- If they do refuse me based on medical grounds and there are exemptions for medical inadmissibility, such as risk to life if refused. Since I am from Somalia and it's a war zone basically do you think I will be exempt from medical inadmissibility?

3- Will my aunty face any charges or get in trouble with the government for what she did?
