Hi

Looking for advice regarding application for a citizenship certificate for my son. His father is Canadian. He was born in Canada to Canadian parents. I am American. My son's birth certificate does not have his father's name on it due to the laws in the state I live in and also many years of estrangement between me and his father. I have contacted two lawyers for advice. One said there may be other documents we could use to support our application The other said we MUST amend the birth certificate. My lawyer here says we can go to court to try and change the birth certificate but there is no guarantee they will do it.

Has anyone used a statutory declaration to explain a more complicated situation? Or has anyone used DNA testing to prove parentage for a citizenship application?
 
I think you should consult a Canadian lawyer about this; perhaps the law firm that is hosting this message board.

You also need to get a certified copy of the father's Canadian birth certificate to prove his Canadian citizenship, as this is one of the required documents when applying for proof of citizenship (see scenario 3). If you don't have this or if he won't give it to you, then unfortunately you got two hurdles to overcome now.

Thank you for your reply. We have no problem getting his father's birth certificate. He is a willing participant in the process.
