1. Can anybody clear if its fine to submit 10th class marksheet instead of birth certificate while applying for PR under CEC category. Me and my spouse, we both dont have birth certificate available
do we need to submit any explanation letter fro the same along with the 10th marksheet. If yes, then whats the format?
I am not sure about for which country you are talking about ?, IF your country was issuing Birth Certificates at your Birth, then you should submit one.
If you do not have Birth Certificates than 10th mark sheet will work as long as it has Your Date of Birth, Mother's Name and Father's Name with a Letter justifying why you are using 10th Mark-sheet (Your country was not issuing Certificates at that time Or you do not have have it some how.)
There cannot be any format for an explanation letter. Each case is different.
Make sure your 10th Certificate has your name, date of birth and father's name and it will suffice. Write a letter to that effect stating 'at the time of my birth, Birth Certificates' were not usually issued in India and therefore, I do not have a BC'.

Instead of 10th class marksheet, my recommendation is submit the 10th class passing certificate as it has the father's name as well.
Also, if both the marksheet or passing certificate don't have father's name, my recommendation is to submit an affidavit towards the birth related information. That has been deemed acceptable by CIC in most of the cases where an actual birth certificate was not submitted.
