1. No. They need to live together for a full year again to establish common law status.
2. Yes. Assume IRCC will find out which will put him at risk for being banned from Canada for five years, as well as having his application refused. If IRCC doesn't figure it out now, they will find out later once he applies for PR and he'll be looking at a refusal for misrepresentation and five year ban from Canada then. It's really a horrible idea to lie in an immigration application. If he wants to have any future in Canada, he needs to be truthful.
3. Again, no. They are no longer common law since he got married. They need to live together for a year again before they can classify themselves as common law.
