guys please help me we are family of 4 but when we filed our visitor my mom mistakenly checked divorced now me and my brother are dependents because she have WP. my question is can my mom sponsor my dad even she stated divorced in the forms or she have to marry my dad again? legally they are married but in the forms they are not. are there any options for us

So your mother stated that she was a divorcee when in fact she is married? Did she check divorced on her work permit application or just your visitor application. Did she declare your father in any of the family information forms? If not then this counts as misrepresentation which means that if CIC finds out that your mother lied on any applications, she will be banned for 5 years from entering Canada.

yeah she did declare on her passport which was issued 2 months before than the visa

Anyway, misrepresentation or not, it depends on that if the wrong information on the form is material or not, which means that was the marital status on the form actually a concerning factor that would lead the VO wrongfully issue the Visitor VISA to your Mom in the first place or not. Let's say if a married woman will be a negative factor to issue the visitor VISA, then what your mom did, intentionally or not, is in fact a misrepresentation, otherwise there isn't any grounds for misrepresentation. And actually, a lot single women did the opposite to claim they were married to show the VO that they had some ties with their countries, that is in fact definitely a misrepresentation.

Although, there may not a misrepresentation, your mom will still need to provide CIC an explanation letter and any other backup documents for this incident.

As I said, your mom didn't misrepresent herself, she simply made a mistake on her visitor VISA form. No, she doesn't need to remarry your Dad again. All you need to do is when you file the sponsorship for your Dad, you need to include an explanation letter and all other related backup documents to CIC to address this incident.

If your mother is a work permit holder, you need to move over to the Foreign Worker section of the forum. This section is for Canadian citizens/PRs sponsoring family members.

1. What is your mother's status with CIC ? When was it obtained ? Since you came here as a visitor, did any employer help your mother get a work permit ?

2. When did you realize the "mistake" of checking the divorced option on forms ? Did you ever notify CIC that their records need to be rectified ?

3. When work permit application was filled out for your mother, what did she indicate under her marital status ?

she is on WP yes an employer offered LMO we realised when she applied for her WP no we did not notify them . it was filed in sep and she stated on WP that she is married
 
As I said, your mom didn't misrepresent herself, she simply made a mistake on her visitor VISA form. No, she doesn't need to remarry your Dad again. All you need to do is when you file the sponsorship for your Dad, you need to include an explanation letter and all other related backup documents to CIC to address this incident.

Your mother can't sponsor anyone, as she is not a Canadian citizen or PR. As I said in my previous post, you need to move over to the Foreign Worker section of the forum.
