I've been wading through the depths of Canadian immigration trying to find an answer to my questions, and I cannot be sure. I hope you experts here can help more than Immigration Canada!
I am a Canadian citizen (American PR) in a common-law relationship with an American citizen. We live and work in Detroit. I am sponsoring my common-law husband for Canadian PR. We intend to move to Windsor just over the border once his residency is approved. I intend to keep working for the US company unless I can find comparable employment in Windsor (not likely given the bad economy there).
1: Will there be any problems with sponsorship if I work for a US company? My income exceeds the minimum threshold required.
2. If I have lived outside the country for the past 7 years, will there be a problem sponsoring him? I have filed zero on my taxes in Canada, requested no deductions/GST payments, but paid income taxes in the US.
The "Sponsorship for a Spouse" application suggests I cannot sponsor him if I live in the US.
You can sponsor your husband from the US. there are no income requirement to sponsor a spouse (just means they won't deny you for not having an income of course they want to know how you intend to support yourself), you can provide your income from the US. since you are in the US you would file an out-land application and with the application provide an intent to relocate letter and evidence... things that prove your intent to relocate could be, quotes for moving your belongings from US to Canada, letters from friends and family that state they know of your intention to relocate once the visa is issued, quotes from a realtor inquiring about rentals or about purchases a home, letter from family member or friend saying you can stay with them until you find a place, letter from employer saying they know of you intention to move and are willing to still employ you, basically anything that you think will show them you intend to relocate. If I were you I would (if you havn't already) apply for a nexus card this will show that you want to make commuting back and forth to work as easy as possible. Good Luck!
Creampop, you're the best. Thanks so much - I've been stressing over this for the past two weeks as I pull together information. The Nexus card is top on the list of documents I need to pull together. Quotes for moving belongings, I never even thought of that!
