Can I apply for student visa while waiting for restoration to be processed?

I came to Canada as a visitor and then applied for my student visa which was denied due to lack of funds. After the refusal I didn’t know I had to apply for restoration so i applies for a visa extension instead. After being rejected the extension I became aware to apply for restoration. I applied for restoration May first week and I am still waiting for it to be processed/ approved. Amongst all this a lawyer approached me saying he can apply for my student visa while I’m waiting for restoration processing. Is that possible? He’s saying he’ll send my passport out of country and that’s how he’ll get it done. Please help me out and let me know what I can do in this situation?
