Can husband apply for Open Work Permit if his wife has employer-specific (LMIA) work permit?

I want to ask for a friend of mine. She is currently working in Canada, on employer-specific (Restaurant server) work permit, valid for 2 years, as of Dec 1, 2022
Can her husband apply for Open Work Permit? If so, when he can apply for it?

I believe the employer-specific LMIA NOC was the job title "Server" in a Restaurant, so according to the new NOC 2021, it should be 65200
