Hi All,
I am Maulik from USA.I am in USA on H1B.I am in USA for last 6 months only.
I want to put up my immigration file from Buffalo office here in USA.
I am leaving USA in 15-20 days now as i dont have good job over here.But i want to put up my immigration file before i leave USA.
My doubt is...
1) Can i put my file from Buffalo office ?? I am here in USA for last 6 months only.
I have 3 years of H1B Visa till Nov-2009.
Please reply me as i want to leave USA soon.

Usually H1B status is for working in a speciality occupation for a particular company. If you do not have a job, the port of entry could reject your futue H1 entry into the US. With this potential risk, it may not be advisable to apply in US. Unless you are sure that you will be able to return back to a job in US, apply in your home country.
As far as I know you need to be in the U.S. for at least one year before you could apply from Buffalo.

He can apply the second day after he lands in the US, provided his entry into the US is for atleast 1 year.
