Can a new employer apply for LMIA?

we are starting a new restaurant, but the type of the chef is no way to find in canada, so we are thinking to hire one from foreign. we registered the company already, and will post advertisements from different sources. but we are unable to submit any T2 or NOA since the restaurant haven't started yet, cuz we cannot start until we actually hired a chef. in this case, are we still able to get LMIA?

You have to check I think you have to show the turnover for a couple of years or so before going for LMIA process.

You would be correct....12 months minimum.

Employers are not eligible to make a job offer to a foreign worker under these immigration programs, if they are:

an embassy,
a high commission or consulate in Canada
on the list of ineligible employers maintained by IRCC
new and have not been in business for a minimum of 1 year, or
hiring workers who intend to reside in the province of Quebec
