Hi,

I just joined the forums - though I have been ghosting around for a while and picked up some valuable information - thanks for that! But now I have a problem and I was hoping that maybe someone has some experience with this. To give you a quick summary:

- I applied for PR under the CEC in October 2014
- February 2015 I was informed that I am now in process
- My current work permit was LMO based (from 2014) and will expire March 20th, 2016
Since I was and am currently working in Quebec and I have to leave the province to advance my PR, I applied for a BOWP in December 2015 - back then the processing time was way lower (around 90 days).
- I found a new job in London, Ontario - great opportunity and nearly perfectly tailored for me and I signed a contract for April 4th, which would have been close enough within the original processing time - but since they are still working on the September applications and state the processing time is now 144 days ... I am scared beyond belief, that my permit will not be issued on time.
- I called the CIC - explained the situation and they tell me basically "Meeep - sorry, there is nothing we can do about this type of permit." No additional phone numbers, no appealing to anyone - plain nothing.
- Though he also told me one thing - and this is why I would like to know if anyone had any experience with it:

He told me that I could go to the border (if I am eligible - which I believe I am) and it would be at the border personnel's own discretion, if they would actually provide me with a work permit. He said that they could do it but also that since I already applied for a permit and since I am already in Canada - they might as well refuse.

Since I am a good 2 hours (without traffic) from the border - I was wondering if anyone can tell me if they have done this before and if they have had any kind of success.
I am really at my wits' end here and I am starting plummet down to desperation.

Any thoughts - advice - hints and experience would be highly appreciated.

Just want to say that there was an episode of Border Security where a person did that and was not only refused (because the WP could not be extended), but was told to leave Canada.

A safer plan would be to talk with your new employer and see if they could hold the position for you until you get through this.

Under what reason where they told to leave?
My permit is still valid for some weeks - and it's not like I am applying for anything illegal. Besides, I would take a copy of the email from the CiC guy with me.
 
I don't recall the exact details, but since his WP extension/renewal was refused, I suspect that was the reason why. He would have been a prime candidate to possibly work without authorization.

Why not contact an experienced lawyer that offers a free phone consultation? There are plenty around...including the firm that provides this website for our use.
 
Thanks - I never thought about that. I think that 'free' and 'legal consultation' usually don't go so well together. :D

There was an episode of "Border Security" yesterday on the Discovery Channel. It is about the CBSA. A Macedonian arrived at the Border Port of Entry to get a new work permit. He originally held an IEC visa, it expired, he submitted an application for an extension, while waiting for the LMO and continued to work. When he arrived at the POE, he was reported, for unauthorized work, banned from obtaining a work permit for 6 months, and as his original TRV and IEC expired had expired, he was reported for not having a valid visa. He was furthered inland to obtain a plane ticket home, and had to report to CBSA with the ticket the next day. So you take your status in your own hands if you continue to work on an expired IEC pretending you have "implied status".


Not very comforting to know that it really is a roll of the dice!

Thanks for clearing that up.

From what I see, the situation is noticeably different from mine - so that gives me a little bit of hope.
My current permit is not yet expired, the new one is in the making and my (hopefully) future contract even includes a paragraph, stating that I will have to have all my papers together to start working there. I'll call the legal advice tomorrow and then I'll have to see.

The thing is just that if the processing time keeps increasing ... I am not sure I can convince my future employer to keep the position open for yet another month and another... So I am really weighing my options here. I hate to be at the mercy of the big faceless bureaucracy where nobody feels responsible and we're all reduced down to numbers and having been told "Sorry, nothing we can do." is so utterly demotivating ...
 
IMO, there is far too much ambiguity when it comes to important issues like this...especially when you'd think/expect CIC and CBSA to at least be on the same page. It should NOT come down to the interpretation of an individual officer at a POE.

I couldn't agree more. The simply fact that you call 4 different people and get 4 different answers ... is infuriating and discouraging to say the least.
And like I said - the simple fact that this guy at CIC told me there was nothing to be done - and that there was nobody else to call ... was flabbergasting.

But these are pretty much my options now - either take up my luck with an individual who may have a heart or not - or stick with the gears of bureaucracy where nobody really cares.

But thanks for the wishes. I really could use some luck right now.
