I am born in India but living in US for past 2yrs. I need to submit an affidavit for DOB as my Birth certificate is missing as per my attorney. My question is where do I get this affidavit done - India or US?
Also, I want to know the list of documents that need notary. I am submitting all photocopies except Police clearance certificates.

Embassy will issue a birth certificate stating that :-
" The date of birth of -----(Name)------------ passport No------ is ----(D.O.B ) --------, as recorded in his/her passport.".
I am not sure about the validity of such certificate, as it is not issued from the office where a person's birth is originally registered.
However, there can be an alternate solution in case of lost records. A school ( SSC/high school) certificate is a substitute document to prove one's birth in lieu of birth certificate.
According to my understanding, if he want to submit any kind of affidavit, that can be signed in the presence of a Consular Officer at the Indian Embassy where he is located.

You (or any person) can get your Birth certificate(if having regd.particulars) by applying to concerned authorities(M.C or D.C office)India after depositing required necessary fee of the deptt. or can get the same under Right to information Act,2006 by sending the letter alongwith fee of Rs10 to the office lies in the jurisdiction of your birth place.
However, you can also furnish the formality of Affidavit from U.S for shortcut. So far as your concern with regard to attestation of document,so I think a noterise affidavit is sufficient.
Attestation of document from cousular office is required ,when the document is supposed to send in India.then it is also requires to be embossed from India.
