Hey guys and gals,
Basically asking this question on behalf of my dad. He is here in British Columbia on a closed work permit. Recently, we have been looking into PR options and think BC PNP would be an ideal option since his CRS score is not high enough for Express Entry; and so we went through the program requirements and eligibility. We are having some confusion about the job offer requirement. So, my dad’s company is registered in Ontario, and the job will state Ontario on it, and through the company he is working for a client who is based in British Columbia. My dad’s work permit also states British Columbia as the workplace location and is our place of residence. So, if he were to apply for BC PNP, would he be eligible since the PNP website states the employer must -
be established as an employer in good standing in B.C.
Just wishing if someone could clarify this.
Additional info- NOC Code 2173
Have you checked out the detailed guide? Suggest you do that if you haven't already. Good standing generally means that taxes are in order, company has no disciplinary action against it, etc. Your father's employer needs to be established in B.C. and meet the requirements in the guide. It sounds like they are established in Ontario and not in B.C. They need to meet the requirements below.
Your employer must meet specific requirements in order to support your BC PNP application. The onus is on your employer to demonstrate that these requirements are met. Your employer may be required to provide financial statements or other documents as supporting evidence.
1) be established as an employer in good standing in B.C.
Your employer must be in good standing and must have one of the following business structures:
1. incorporated or extra-provincially registered
OR
2. registered as a limited liability partnership in B.C.
OR
3. an eligible public sector or non-profit employer
Your employer must be permanently established in B.C., as defined by the federal Income Tax Act.
Your employer must have operated in B.C. for at least one year (two years if you are registering under the Entry Level and Semi-Skilled category, including employment in the Northeast Development Region of B.C.)
What stream? For Skills Immigration and EEBC PNP, It is more than being established in good standing. The employer must be incorporated or inter-provincially incorporated in BC & permanently established in the province (page 50). Also on page 50 is the number of employees the employer must have in BC. You need to ask the employer where it is incorporated and whether taxes are paid in BC. Sounds like the company is in Ontario and your dad is working for a client in BC.
