Automatic Visa Revalidation (AVR) to enter USA for H4

Hi All,

Starting a new thread, As the H4 visa laws has changed.

I will explain you the situation here, The H1B is approved and H4 filed along with H1B is still waiting for approval as USCIS changes the way H4 approved now a days due to Biometric.

Earlier H4 use to approve along with H1B but now the things has change.

My Question is to all the experts - Is the AVR for H4 is based on Spouse H1B (747 Approval notice) or H4 should wait for the H4 extension.

Both Me (H1B) and My Spouse (H4) Visa has expired, My H1B extension has recently approved (I-747A), However my Spouse is still waiting for the approval, In this scenario can AVR facility used by H4 holder if both H1 and H4 are travelling along.

Sharing my experience from last month. Both of our I-94s were expiring in Apr. 2021. Our H1b and H4 stamps have expired in 2019. My H1b extension got approved in Dec 2020. We crossed the border and came right back after making U turn. The US CBP issued new I-94 for my wife, matching with new H1b I-94 date (3 years). They let both of us enter on AVR. I hope this helps.

I had one quick question though - you had your h1b approved in Dec 2020, so while using AVR, your wife's i-94 was updated for three years as well? did she have her new h4 application approved as well?
