I am writing on behalf of an illegal immigrant in UK who was taken to UK from Kazakhstan when he was 15 years old. he is now 28 and still residing in UK. last year he met a girl (my cousin) and they had a baby together. He cannot work legally, has not obtained UK citizenship and does not have a passport. He would like to move to Canada with his family. Can he apply for asylum/refugee status in UK for Canada or do you have any information i can pass on to him. he feels stuck in UK, can't go back home and can't settle in UK

1. Is your cousin British or does she have ILR? Or is she Canadian?
2. He could have applied for leave to remain in the UK if he had applied between the ages of 18 to 24.
3. As he has stayed for several years, he might still be eligible to apply for leave to remain. He needs to take the advice of a specialist legal adviser in the UK.
As he has lived in the UK for the last 13 years, it would likely be difficult to convince anyone within the IRB that he has a valid claim. He currently resides in a safe country, but has yet to apply in the UK. He could certainly apply to the UNHCR in the UK and wait for resettlement, but it may not be Canada. I suspect his best opportunity is in the UK.
