Hi there- first off, this website is AMAZING. SO much more informative than all the gov't websites.
My husband and I are in the middle of figuring out his sponsorship visa. We were married in Australia last year, and then moved to Canada (I'm Canadian, he is Australian), with him on an IEC 2 year working holiday visa. His IEC expires Dec 2016, but as far as I can tell he can renew it for another 2 years upon expiry.
If we apply for spousal sponsorship outland via Sydney just after his IEC renewal, can he keep the IEC work rights while his PR is being processed in Sydney? Any advice as per the best way - the consensus seems to be outland>inland, but him being able to work is pretty important! Any advice would be so helpful, thanks in advance!!!
As long as he got the IEC before 2015 he can apply for another 12 weeks before the current one expires.
I agree with canuck, get your application in as soon as you can, don't wait until the current IEC expires. He can continue to work with a PR app in process as long as his permit is valid. There have been several Sydney applicants from June/July that have already been approved, its a fast VO.
Keep the plan for getting another IEC as a backup if his PR doesn't arrive in time.
oh okay i will look further into it. so he could apply to renew his IEC even with a sponsorship application in process?? Also, he can re-enter canada if we apply outland? we have a trip planned to europe in may so i don't want to do anything that would risk him being unable to re-enter canada on our way home.
He should have no issues reapplying for IEC with an application in process, CIC will only assess him to the IEC criteria.
Entering Canada after a vacation should also be no problem, people leave and return with an application in process all the time. The main reason people have issues is if CBSA suspect them to be living in Canada and not visiting. Since your husband has a work permit, this shouldn't be an issue. I've left many times and returned on my IEC and have never had a problem.
If you get the application off soon enough he may even get approval before the May trip and can land as a PR when you return
