hello.
i have kind of difficult situation, so i need some advice.
I currently live in S. korea and married canadian and have a daughter.
I plan to apply sponsorship in s. korea this year( i could not do earlier becaus of pregnancy).
but we might go back to canada end of this year, so even if i apply this month, july, i would not get any result back from cic.
so i wonder if i live in canada, i have to restart again ( apply, pay fee, medical etc. )

another question is if i apply in canada, i would have visitor visa until my immigration application is approve.
do i need to renew my visitor visa after 6 month or is there any other way , i can stay without renewing visa .

please give me some advice.

If you are able to come to Canada before your file is done processing you will not need to start over. It will be an outland application, so you traveling is not an issue. The only thing is to make sure you notify the VO of your whereabouts and contact information.

With regards to the inland (applying once you get here) part of your question: If you come to Canada before applying you should keep your status legal and renew your visa one month before it is set to expire. There is implied status but I believe that is for those who have also included an application for a work permit. Since you mentioned a baby, I assume you would not be looking to work right way.

There are others here that will be able to give answers and or correct me if I missed anything.

If you apply "outland", then you can send in the application immediately, or as long as it takes to gather all your info, fill in the CIC forms and do you and your daughters medical. The application would be sent to CIC-Mississauga first, and they they would forward it to Manila to complete the processing. During the entire processing time, you and your daughter could travel to Canada as a tourist/visitor only. So the most time you could get is 6 months, and then you would need to renew the visitor visa. Also you would be able to go back to Korea if needed during the processing, and PR app would not be affected.

If you apply "inland", you need to wait until you are actually in Canada as a visitor, before you apply. With inland you will get implied status in Canada, meaning you and your daughter can stay in Canada legally during the entire processing time. This also means you should NOT leave Canada for any reason during the processing, which for inland can be around 1.5 years.

Since you are married and have a daughter, your case should be very easy for a VO to approve as long as you do the application correctly. Outland may be your better and faster choice here, but if you choose this you will just need to ensure you can extend your visitor status here after the initial 6 months in Canada if needed.

Actually if you can complete the application in July and send to CPC-M by around Aug 1.... your application could be done within 8 months or so (or around March-April 2014). If you travel to Canada end of this year and get a 6 month visitor status say until May/June 2014, your PR may be completed and sent to your Canadian address before you even need to renew your status. Of course there is no guarantee of this and some of it will depend on luck!

I just wanted to clarify, if your daughter's father was either born in Canada or naturalized in Canada, then she is a Canadian citizen as well; in that case, she doesn't need a medical and is not included in your sponsorship app. You can just apply for her Certificate of Citizenship.
