My husband and I are looking for some advice on whether or not we should apply to extend his stay as a visitor - tried the call center and they were not at all helpful.

My husband arrived in Canada mid-July as a visa-exempt visitor - he has status until mid-January 2016.

Our inland application was received by CIC on November 6th along with an OWP application (all appropriate fees included). We checked the morning before mailing that all forms were not expired. Just last week 2 forms were updated IMM0008 (Generic Application Form) and IMM 5710 (Application to change conditions - aka Open Work Permit). Responses have been mixed on whether or not CIC will send back or app or request these update forms.

My concern is with the OWP form and that is what gives implied status. Given that my husband visitor status ends in January and the OWP could be sent back, we are wondering if we should apply to extend his stay as a visitor anyway? Or should we wait it out? We have spent a great deal of time long distance and want to stay together, would hate to see him have to go back to Korea.

Any advice is appreciated!

I would definitely extend to play things safe and cover yourselves in case the application is in fact returned.

Should we indicate in this application that we have submitted an inland application as well?
 
Thats the right page, and I would apply for extension just to be safe as said, but even if you don't and the package/OWP is sent back in say February, I believe you would still apply for restoration of status anyway.

Yes, that's the correct package and yes, you should declare that you've applied for PR.
 
What proof is recommended to show that we have applied for PR? Is the fee receipt enough? Should we also inform them that we submitted an application for OWP?

Yes, the fee receipt is good proof. If you receive AOR before then, include that as well. There's no need to mention the OWP app.

Thanks. I doubt we will have AOR as hoping to apply by mid-December (just 30 days prior to expiry). We only sent our PR application a little over 3 weeks ago and have heard nothing, which according to the Inland spreadsheet will continue for a while.

In the details of visit to Canada section on the IMM 5708 form...
- does he just list the purpose of his visit as "other" and write that applied for PR?
- Indicate how long to stay (from and to)... Confused here what to put. He arrived in July 2015 and the goal is obviously that he will stay indefinitely since we have applied PR. What dates do he list?
- Persons I will visit - Does he just list myself (his wife) ??

We are submitting this package in hardcopy, but want to pay the fees online. On the document checklist it lists "Stamped Receipt (IMM 5401). Can we just print and include the $100 receipt after paying online?

- Think in terms of visiting, not permanent residency. I suggest he ask for 6 months, as that allows plenty of time for the OWP to arrive.

Hi there I have a question on this as well. We are in the same process as you are. Spouse is in Canada right now on visitors visa (arrived Nov 25). Our app for permanent residency is going in within the next day or two. What forms did you submit for the open work permit that you included with the application for residency (we are doing spousal sponsorship in the family class)? Can you give me the numbers please. I am getting myself confused on what forms we are supposed to fill out for OWP. The new pilot program is in effect till end Dec 2015 so I assume your husband should get his work permit and be eligible for medical benefits within 4 months of your application for permanent residency? Thx so much.....

It doesn't need to be notarized. Including the bank statements and payslips will be fine.
