hi all, can someone tell me if a spousal application is going through the process and the sponser has been accepted, can the sponsor then leave Canada and come to the Uk for a couple of weeks, my husband is a Canadian citizen he has permenent residency still in the Uk from living here for 10 years and needed to come back to the UK to tie up some loose ends, is this possible.

yes Canadian citizens can leave the country the only problems are the person being sponsored leaving during an inland process and the person does not come from a visa exempt country it is not recommended to leave as if u are not admitted back in the country your application goes out the window.... Mandy are u in Canada as well, did your spouse do an inland ou outland
no Im in the Uk still my hubby is in canada, he was hoping to come over end august early september and then tie up things then leave again, wish i could go with him just scared to take the chance with me having an over stay (deaprture order0 10 years ago incase they refuse me entry.
well yes he can leave at anytime as he is a citizen already as for you maybe its not best to attempt to come as when they are doing background check the may see a refused entry and they will see the departure order and they may say you got married to get back into Canada putting your case under even more scrutiny, i know you want to be with your husband but my advice don't attempt to come back until you are granted a PE you dont want to give the VO more reason to feel you are just itching to come...IMO
hi mandy yes ur hubbie can come to visit u as many times as he pleases it will not affect ur application...if he does stay longer and he looses the Canadian residency status he needs to prove he's going back with u, he still has ties there, etc....better avoid this siuation
as for u going during the application process, as a UK citizen u could, but considering ur past experience, i don't know what's best....being far from ur hubbie is hard too...if u go don't overstay...ask some legal expert what they recommend, call CIC and ask their advice too
thanks for all the replies. After a long hard talk with my OH we have decided to wait until the application has completed, it is very hard being without eachother, but think it is better to wait than to risk ruining everything for a few weeks. I just hope seen as we have been married for 12 years , have no dependants or medical issues and no criminal records, that the application will go through quickly. but then I guess it depends on when they get to it as well We will soon see as the application is being sent off this week.
