A US permanent resident married to a protected person in Canada

Hi, my wife is a US permanent resident and I am a resident of Canada awaiting Canadian permanent residence. My wife is now here in Canada in visitor status I recently added to my application to live here in Canada now my wife needs to go back to the US to visit family can she go and back to Canada easily or not

Yes she can go but she might have difficulty coming back. May be somebody else can answer too

Re-entry to Canada is never guaranteed, even for US green card holders. Generally US green card holders have no issues entering Canada as long as it's clear they are just visiting and have no plans on remaining long term. Your wife's situation is a bit more complicated since her name has been added to a refugee application which shows a clear intent to remain in Canada long term.

I think the best answer any of us can give you is that the outcome is uncertain if she leaves. It's quite possible she will be allowed back in but also some chance she may run into issues.

I think he meant that name was added to permanent residence application and not the claim itself. I think dual intent is allowed in such cases right?

Claiming dual intent doesn't give someone the right to enter Canada. Entry can still be refused.

Hi - dual intent is entry for a temporary purpose, so the questions at the POE would be, what are you going to do and when are you leaving?

It remains possible that they could deny entry as a visitor. The person may also be granted entry without much scrutiny. Scylla's correct as usual.

I agree. After all entry to non residents is essentially always at discretion of the CBSA.
