Hi all, im hoping someone could share some light, my husband and I seperated end of 2023 and we have not gone through the divorce proceedings in South Africa, thereafter he had the opportunity to go to Canada which he did on a work visa and should receive his PR in about a year, however while applying for the original work visa he stated "separated"on the documents, however after some discussions we would really like to get my daughter over for a better life opportunity (I will be with her)...
From the understanding I have, he will never be able to sponsor us now as he stated "separated" / "not sponsoring"anyone on the visa originally. Is there no way this can be changed and will this be the status now concrete going forward?!

You don’t qualify if you’re separated but your child would. If he attempts to include you as accompanying on an PR application and you are not actively involved in a relationship with proof he could be banned for misrepresentation. This is not a viable plan.

My understanding is that what matters is what is on his PR application.
Note: that is, for purposes of the question you asked, i.e. whether you/daughter would be 'banned' / never able to be sponsored.
And @canuck78 is correct that he cannot sponsor you as his separated spouse; if you claim to be reconciled, it will be looked at quite carefully (with severe consequences if they determine he is not being truthful).
My suggestion is that he should include his daughter as non-accompanying; that way she can be sponsored in future if you and he work out custody that allows her to live in Canada.

Your child should be included in the application and can get PR at the same time as your ex partner.
You can only be included in the application if you and your ex partner are back together again and can show you are once again in a relationship. He cannot include you just so that you can get a better life. You must be together/in a relationship.
