I am a Permanent Resident living in Canada sponsored by my spouse in 2017. I have a 9 year old (US Citizen) who has lived here with me the entire time. I was initially granted a student visa and at the time told my daughter did not need any other documentation on her end. She has a right to school and travel in and out of Canada.
However, at Christmas we traveled to the US and upon re-entry flagged because my daughter has no status in Canada. The officer shrugged and said she is okay as long as I’m a permanent resident, but I just want to be safe!
Applying for permanent residency for her seems off the table as her father refuses to fill out paperwork granting permission for application (if there is a way around that, by all means let me know!). Can I apply for her a study visa just to be safe?
It’s a bummer because she doesn’t qualify for health care, but we can live with that as long as she is not denied entry

This is not a longterm solution. After you stopped being a student she no longer had the right to stay longterm. Depending where you live she actually shouldn’t qualify for school.

I have searched everywhere for options besides permanent residency for her. Her biological father is just non-cooperative and I’m stuck.

Does he have custody? Yes a study permit may be an option and you would need to pay international fees. It could eventually be denied which is a problem. If she gets sick and you use the health insurance you hopefully have she could become uninsurable for that issue. You only really have emergency medical coverage.

We have joint custody. She moved here with me no qualms but as soon as PR was processed I began to ask for the no-contest form from him and he has refused.

I’m confused -
For a student visa for a minor it states the child does not need a visa if the parent is entitled to work/study in Canada.
How does being a PR affect that statement?
