I GOT THIS BELLOW EMAIL FROM IRCC NIAGARA FALLS OFFICE TREATING MY H&C APPLICATION WHICH IS NOW 20MONTHS , I AM CURRENTLY A PROTECTED PERSON. I DIDN'T APPLY FOR PR YET BECUZ I STILL HAVE PENDING H&C WHICH IS NOW 21 MONTHS .
This refers to your application for permanent residence on Humanitarian and Compassionate (H&C) grounds. We have realized that, since you first applied for permanent residence on H&C grounds, you have been granted protected person or refugee status in Canada. As such, you are entitled to apply for permanent residence in the regulatory class for Protected Persons and Convention Refugees. This class has different eligibility criteria than H&C, which may be of benefit to you. By applying for permanent residence under the Protected Persons and Convention Refugees class, your application can include your family members abroad, who will be concurrently processed for permanent residence (they must meet the definition of “family members” in R(3)). Also, some inadmissibilities do not apply to the Protected person’s class applications. Your application may be considered under these provisions if you indicate to Immigration, Refugees and Citizenship Canada that you wish to be considered under this category. Should you wish to be considered under this category, please send the requested agreement (attached) to this office, together with the required forms and include a copy of this letter. The documents must be received at the address above within 30 days of the date of this letter. To obtain the necessary form(s), please visit the Immigration, Refugees and Citizenship Canada (IRCC) website:
https://www.canada.ca/en/immigratio...da-protected-persons-convention-refugees.html Should you choose not to be considered under this category, or if we do not receive your response within 30 days, your application will continue to be processed as an application for permanent residence on H&C grounds, in which case you are required to demonstrate that sufficient humanitarian and compassionate considerations exist in order to gain an exemption from certain requirements to allow your application to be processed from within Canada. If you require clarification or additional information, visit the IRCC website at
http://www.cic.gc.ca or telephone the IRCC Call Centre at 1-888-242-2100. The UCI number in this letter is your personal identification number and it provides access to information on your file. For your own protection, do not allow any other person to use this number.
